USER TERMS AND CONDITIONS

IMPORTANT NOTICE: It is illegal to sell alcohol to people under the age of 18. By placing an order, you must confirm that you are 18 years old or above. You must ensure that no other person shall use your login to purchase alcohol products and a person aged 18 or above (identification required) must be present to take delivery, otherwise delivery shall be withdrawn and attempted at another time agreed between you and us.

General

Please read these terms and conditions carefully before using our e-Stores (as defined below). By creating an account and/or using our e-Stores (as defined below) or any part of it, you agree that you have read the terms and conditions set forth herein, including the Order and Delivery Terms (as defined below), the Privacy Policy (as defined below), the Loyalty Program Rules (as defined below) (collectively and together with any other policies and terms adopted by VinoBuzz from time to time, the “Terms & Conditions”) which may at our absolute discretion be revised from time to time, and that you understand and irrevocably accept and agree to be bound by these Terms & Conditions. You agree to review these Terms & Conditions periodically and the continuing access to and/or use by you of any of our e-Stores shall be deemed as conclusive evidence of the irrevocable acceptance by you of these Terms & Conditions as they become effective from time to time.

Definitions and Interpretations

Unless the context otherwise requires, in these Terms & Conditions,

“content” includes any or all text, graphics, logos, icons, photographs, images, videos, moving visual representational images or a combination of sounds and any of the foregoing, audio, computer programs, and other materials featured, displayed or used in or in relation to our e-Stores;

“e-Stores” means our website, https://vinobuzz.ai , our mobile application VinoBuzz, and/or our other online stores that provide services and offerings (as the case may be) through which you may view and place merchandise available for sale thereat with us;

“Hong Kong” means The Hong Kong Special Administrative Region of the People's Republic of China;

“intellectual property rights” includes any and all patents, trademarks, rights in brand name, rights in domain names, rights in designs, copyright and database rights (whether registered or not and any applications to register or rights to apply for registration of any of the foregoing), rights in confidential information and all other intellectual property rights of a similar or corresponding character which may subsist now or in the future in any part of the world;

“Loyalty Program Rules” means the VinoBuzz Loyalty Program – Points Rules (V4.2) of VinoBuzz as updated from time to time, which is attached hereto as Exhibit B;

“merchandise” means the goods (including wine) or services which you may list them available for sale at or through our e-Stores;

“Order and Delivery Terms” means the order and delivery terms of VinoBuzz as updated from time to time, which is attached hereto as Exhibit A;

“Privacy Policy” means the privacy policy of VinoBuzz as updated from time to time and is shown at https://vinobuzz.ai/summary-policies ;

“Seller” is a reference to the person, firm, company or any other body corporate or unincorporated which accesses to or uses our e-Stores and make any merchandise available for sale with our e-Stores, whether in the capacity or a seller, merchant, contributor of content, or any agent, consultant or contractor thereof or otherwise;

“User”, “Buyer”, “you” or “your” is a reference to the person, firm, company or any other body incorporated or unincorporated which accesses or uses our e-Stores by placing an order of merchandise;

“VinoBuzz”, “we”, “us” or “our” is the brand name under which our e-Stores are established, developed and operated by VinoBuzz Limited; and

“Working day” means a day (other than Sunday) on which commercial banks in Hong Kong are open for business.

In these Terms & Conditions, unless expressed to the contrary or the context otherwise requires:
words denoted in the singular only include the plural and vice versa; words denoted in any gender include all genders; and terms denoting people or persons include both natural and legal persons (such as corporations) and vice versa;
a reference to legislation includes any amendment to it, any legislation substituted for it, and any subordinate legislation made under it and, unless expressly provides the otherwise, refers to legislation enacted in Hong Kong;
a reference to “user”, “Seller” or “we” includes that party's personal representatives, successors and permitted assigns and if that party comprises two or more persons, it means each of the persons individually and any two or more of them jointly;
the expressions “including”, “include”, “for example” or “such as” shall be construed only as illustration or emphasis and shall not be construed or take effect as limiting the generality or earlier words;
another grammatical form of a defined expression has a corresponding meaning; and
where time is to be calculated by reference to a day or event, that day or the day of that event is excluded

Registration

You are required to register with us to create a user account with us when you use our e-Stores or any of our other services or place an order. By registering you are making a statement, upon which we are entitled to rely, that you are aged 18 years or above and capable of forming a legally binding contract. In consideration of your use of our e-Stores or any of our other services, you irrevocably and unconditionally agree to:

provide true, accurate, current and complete information about yourself during registration and promptly update your registration information thereafter. If we have reasonable grounds to suspect that any information is untrue, inaccurate, not current or incomplete, we have the right to suspend or terminate your registration;
safeguard your username and password with reasonable care; and
authorise us to assume that any person using our e-Store, the Website and/or the Mobile App with your username and password is either you yourself or is authorised to act for you.

Orders

Except where otherwise specified, we are not a seller or supplier of any merchandise on our e-Stores. We are only responsible for managing and administering our e-Stores, arranging order processing and fulfilment for the merchandise you ordered from the Sellers through our e-Stores.
Each Seller will be solely responsible for providing and shall make every effort to ensure that prices, details and sizes of merchandise he/she offers at our e-Stores are up-to-date and the descriptions thereto are as accurately as possible. Prices and other details are subject to change without prior notice.
When you place an order of merchandise, you are making an offer to buy from the Seller the merchandise you have specified at the price stated for that merchandise. Once an order has been submitted, you cannot cancel the order even if the acceptance or rejection of your order is still pending, and the order is subject to our and that Seller’s acceptance at our sole discretion and stock availability.
We do not represent or warrant, and we deny any responsibility for the accuracy or completeness of the descriptions or other contents, including but not limited to vintage, provenance, authenticity, quality and condition of any merchandise as may be stated on our e-Store. Any and all statements made and information and other contents provided relating to the merchandise offered on the e-Stores are merely those by the relevant Seller and at no time can be construed as warranties and representations of fact or assumptions of any liability on our part.
All orders are subject to confirmation of final availability, and each Seller shall have the right to reject an order in the event that any of the merchandise requested is unavailable. In the event that a Seller is unable to fulfil any of the merchandise in your order, we will, except in unforeseen circumstances, notify you by phone, email, SMS or notification via the Mobile App before your requested delivery date.
You are requested to examine the merchandise immediately upon delivery / collection for any deficiencies and/or damages. Claims (if any) must be lodged in accordance with the “Return, Exchange or Refund” section below, otherwise any breakages or shortfalls shall be deemed to have occurred thereafter.

Price and Payment

All merchandise prices listed on our e-Store are in Hong Kong dollars. The applicable price shall be the price listed on our e-Store as at the date of purchase.
Acceptance of an order is subject to our and that Seller’s sole discretion. If the order is cancelled by us or that Seller, and you have already made a payment, we will make a refund to you. You agree and accept that we will not be obliged to offer any other remedy or compensation for disappointment suffered or any other ground whatsoever.
We only accept such modes of payment as specified on our e-Store including credit/debit cards (Visa, MasterCard and American Express) issued in Hong Kong, Alipay Hong Kong, WeChat Pay Hong Kong and FPS (Faster Payment System). When you place an order of merchandise, you irrevocably authorise us to debit from such mode of payment you specify on your order for the amount that you are liable to settle at the time our acceptance of your order is acknowledged and you represent that you are authorised to make such payment. Title to the merchandise does not pass to you until full payment has been received and delivery of the merchandise has been made.
We use third-party payment services to process online transactions. When you place an order, you agree and accept that your credit card (or any other mode of payment) information will be collected, processed, and kept by us and a payment service provider subject to its terms and conditions. You agree and accept that you are solely and exclusively responsible for any losses incurred or sustained by you in making credit card and other transactions, and in no event shall any such losses in whole or in part be borne by us.

Delivery

Unless otherwise specified, please refer to our e-Stores for details of the delivery charges and free delivery threshold. We reserve our right to amend the provisions thereof at any time without prior notice.
The merchandise shall be, and shall be irrevocably deemed to be, delivered and accepted by you when the merchandise is delivered to the address you provide us for delivery.
Subject to prior online arrangement, you may be offered to select from any one of the delivery time-slots available at the time you make your order. Any times and dates given for dispatch of merchandise, or the length of time that merchandise will take to be delivered, are only estimates. If we are unable to meet any stated dispatch or delivery dates or times, we will inform you as to the progress of your order. You agree and accept that only under exceptional circumstances will we accept cancellation of order or refund.
The title to and risk of the merchandise pass to you upon the delivery of the merchandise.
The Order and Delivery Terms shall apply to each order.

Return, Exchange or Refund

Although we strive to offer wines in their best condition, you must make appropriate allowances for natural variations of conditions of cases, labels and corks for wines. Therefore, we respectfully state that unless otherwise stipulated, no return, exchange or refund of merchandise will be accepted.
You must inspect the merchandise immediately upon delivery for any deficiencies and/or damages. Subject to return or exchange policy specified by certain individual Sellers, claims (if any) must be lodged within 24 hours from the time of delivery, otherwise you will be irrevocably deemed to have accepted the merchandise in full satisfaction, and if you notice that you have received wrong or broken items, or any merchandise is with a shortage, or otherwise out of condition, please notify us within 24 hours of receiving the merchandise either by WhatsApp to our customer service hotline +852 6901 7569, email to cs@vino-intel.com or via customer service channels available in our e-Stores. Please note that many of the merchandise are old or rare wines which may be past their peak drinking window and may be either unpleasant, undrinkable, or not in the best condition in terms of their fill levels, labels and physical appearance. We accept no responsibility for a wine being faulty, unpleasant or undrinkable. Please also read the Section “Disclaimer and Limitation of Liability” below.
Any merchandise acceptable for exchange is subject to stock availability. In the case of an acceptable return of merchandise, all gift items with purchase must be returned together with the returned merchandise, otherwise you will be charged the retail value of the gift item.
Notwithstanding anything in these Terms & Conditions to the contrary, we shall not be liable for any failure to meet any obligations caused by circumstances beyond our reasonable control, including but not limited to acts of God, war, flood, fire explosion, civil disobedience, governmental action, legislation not in force at the of the time of promulgation of these Terms & Conditions, restraints imposed by governments or any other regulatory authorities, labour disputes, trade disputes or delays of parties over which we have no reasonable control.
In case of any dispute, our determination shall be final and binding on you except manifest errors.

Disclaimer and Limitation of Liability

You agree that you are making use of our e-Stores at your own risk, and that they are being provided to you on an “as is” and “as available” basis. We make no warranties, express or implied, with respect to our e-Stores, the AI chatbot services used therein, and your access to our e-Stores or any part of it will be uninterrupted, accurate, reliable, timely, secure, or free from fault, viruses or other harmful components. To the fullest extent permitted by law, we hereby disclaim all warranties, express or implied, on our services will be provided with due care or diligence or any merchandise made available on our e-Stores, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement and the accuracy or completeness of the descriptions or other contents of the merchandise provided by the Sellers.
You agree that no data transmission over the internet can be guaranteed as totally secure. Whilst we strive to protect such information, we do not guarantee and cannot ensure the security of any information which you transmit to us. Any information which you transmit to us is transmitted at your own risk.
In addition, to the extent permitted by law, neither we, our subsidiaries, holding companies, subsidiaries of such holding companies nor any officers, directors, employees, agents, business partners or associates, consultants or contractors of any of the foregoing (collectively, “our associated parties”) shall be liable for:
1. any damages whatsoever resulting directly or indirectly from:
  - your use or misuse of or your inability to use our e-Stores or otherwise our e-Store, any merchandise or our other services being unavailable;
  - any delays or disruptions in our e-Stores or any merchandise or our other services (including any delivery, transportation or any other handling whatsoever of your merchandise) being made available or any negligent provision of merchandise or our services;
  - any damage to a merchandise ordered by you or its quality or (in the case of bottled wine) the label, cork, capsule or any other part of the bottle thereof during the course of or associated with the transactions on the purchase or order of a merchandise or our other services (including any delivery, transportation or any other handling whatsoever of a merchandise) being made available or any negligent provision of merchandise;
  - any information or content provided or procured by Sellers or other third parties via hypertext links or otherwise;
  - any errors or inaccuracies of any kind in our e-Stores;
  - any AI generated contents by the AI chatbot used in our e-Stores;
  - viruses or other malicious software obtained by accessing or linking to our e-Store, the Website and/or the Mobile App;
  - any suspension or other action taken with respect to your account by us;
  - any misrepresentation made on or in connection with our e-Stores concerning any merchandise sold through our e-Stores; nor
2. any indirect, incidental, special, consequential or exemplary damages (even if we have been advised of the possibility of such damages), including loss of profits, business or goodwill, arising out of, relating to, or in any way connected with any issue you notify us of.
You must strictly observe and comply with all applicable laws, rules and regulations relevant to your purchase of merchandise, including obtaining all necessary customs, import or other permits to purchase merchandise from us. We make no representation and accept no liability in respect of export, import or otherwise movement of any merchandise you purchase beyond the jurisdiction of Hong Kong.
Some laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. In such cases, our obligations, where permitted by law, will be limited to the resupply of our services or the merchandise to you.
Notwithstanding the above, in no event shall the aggregate liability to you or to any third party owed by us and our associated parties exceed the lesser of (i) an amount equivalent to 3 times the price of the merchandise in dispute or (ii) HK$1000. Furthermore, you agree that any cause of action arising out of, related to, or in any way connected with the site or these terms of use must commence within one (1) year after the cause of action accrues. Causes of action brought outside this time period are waived absolutely.
Each of the above exemptions, exclusions and limitations shall be construed as a separate, severable and independent provision of these Terms & Conditions.

Your Warranties and Indemnity

You represent, warrant and covenant that you will not:
use our e-Stores for any fraudulent or unlawful purpose;
use our e-Stores to defame, abuse, harass, stalk, threaten or otherwise violate the rights of others, including others’ privacy rights or rights of publicity;
interfere with or disrupt the operation of our e-Stores or the servers or networks used to make the Website and/or the Mobile App available; or violate any requirements, procedures, policies or regulations of such networks;
transmit or otherwise make available to our e-Stores any virus, worm, Trojan Horse or other computer code that is harmful or invasive or may or is intended to damage the operation of, or to monitor the use of, any hardware, software, or equipment;
reproduce, duplicate, copy, sell, resell, or otherwise exploit for any commercial purposes, any portion of, use of, or access to our e-Stores;
modify, adapt, translate, reverse engineer, decompile or disassemble any portion of the e-Stores;
frame or mirror any part of the e-Stores without our express prior written consent;
create a database by systematically downloading and storing any content or user content of or relating to our e-Stores; or
infringe any copyright, design rights and intellectual property rights in any merchandise or any part of our e-Stores.
You agree to indemnify, defend and hold us and our associated parties harmless from and against any and all claims, liabilities, losses, damages, obligations, costs and expenses (including interest, penalties, and legal fees and amounts paid in investigation, defending or settling any of the foregoing) arising out of or relating to:
your access to or use or misuse of our e-Stores and/or any personal data and content obtained therefrom;
your user information;
any actual or alleged violation or breach by you of these Terms & Conditions or of any representation, warranty or covenant that you have made to us or the relevant Sellers;
your violation of the law;
your negligent or willful misconduct; or
your violation of the rights of any third party.
Without prejudice to any of the foregoing, you acknowledge that you are solely responsible for all user generated content (“User Content”) created, provided or uploaded by or through you on or to other users through our e-Stores, including any data, text, files, images, photographs, sounds, videos, messages, tags or other materials. In any case, none of the User Content may at our sole determination be regarded as obscene, profane, vulgar, offensive, abusive, aggressive or contain hate speech or harassment. We are not responsible for the content of any User Content created, provided or uploaded by you or other users.

Personal Data and Cookies

All personal data held by us will be kept confidential and in accordance with the Personal Data (Privacy) Ordinance (Cap. 486), but you agree that we may disclose or provide such data to the following parties:
subsidiaries, holding companies, associated companies or affiliates or companies controlled by or under common control with us;
any other person who is under a duty of confidentiality to us who has undertaken to keep such information confidential; and
any financial institutions, charge or credit card issuing companies, credit information or reference, or collection agencies necessary to establish and support the payment of any services being requested.
During your use of the e-Stores, we may issue to and request from your computer blocks of data known as “cookies”. You must not alter any cookies sent to your computer from the e-Stores and you must ensure that your computer sends correct and accurate cookies in response to any relevant request from the e-Stores. Cookies enhance the performance of our e-Stores by providing a secure method for user identification and improving navigation. Your privacy and security are not compromised when you accept a cookie from the e-Stores.
Our Privacy Policy Statement, which will be provided upon request, is incorporated into and forms part of these Terms & Conditions.

Intellectual Property Rights

All copyright and other intellectual property rights that vest in the works comprised within our e-Stores or ancillary to it are owned by us or our related companies or are licensed to us by the Sellers or other third parties. We hereby reserve all intellectual property rights in any services offered by us, including without limitation to our brand name VinoBuzz, our trademark and trade dress, the contents of our e-Stores, and the domain name. Any use by a user of our e-Stores does not entitle the user or any other person, company or organisation to claim ownership or right of any intellectual property or similar rights in the content of our e-Stores.

Terms and Conditions, Privacy Policy and Additional Terms

These Terms & Conditions, as may be amended from time to time at our discretion, and Additional Terms (as defined below), govern your access to and use of our e-Stores.
We may revise these Terms & Conditions from time to time. We will make sure your acknowledge of the new Terms and Conditions by requiring you to read and agree to the updated Terms & Conditions before continuing to use our services, posting the revised Terms & Conditions on our e-Stores, or notifying you by email with the updated effective date. By continuing to use our e-Stores, subsequent to any revision of Terms & Conditions, you agree to be bound by such changes.
If you do not agree to these Terms & Conditions, you must immediately terminate use of our e-Stores.
In some instances, users are subject to operating rules or additional terms that govern the use of certain parts of our e-Stores or services offered by a Seller or us (the “Additional Terms”) such as the specific refund or return policy of each individual Seller. Unless otherwise expressly set forth as part of any such Additional Terms, any such Additional Terms are made in addition to and form part of these Terms & Conditions and are incorporated herein by reference. Users of our e-Stores agree that we may provide Additional Terms at any time. To the extent any Additional Terms conflict with these Terms & Conditions, the Additional Terms will prevail.

Other Provisions

We reserve the right at our sole discretion to deny users’ access to our e-Stores or any part thereof without notice and to decline to provide our services to any user that is in breach of these Terms & Conditions.
If any provision of these Terms & Conditions is held invalid or unenforceable by a court or administrative body of competent jurisdiction, such invalidity or unenforceability shall not affect the validity or operation of any other provisions of these Terms & Conditions which shall remain in full force and effect. If any provision of these Terms & Conditions is so found to be invalid or unenforceable but would be valid or enforceable if one or some part or parts of the provision were deleted or modified, the provision in question shall apply with such minimum modification(s) as may be necessary to make it valid and enforceable as near as may be to its invalid or unenforceable form.
We may assign these Terms & Conditions or appoint any third party, including our associated parties, to provide the services to you on our behalf or to fulfil any of our obligations under these Terms & Conditions.
You shall not assign or otherwise deal with its rights and obligations under these Terms & Conditions, whether in whole or in part without our written consent.
These Terms & Conditions set forth the entire agreement and understanding of the parties and supersede all prior oral or written agreements, understandings or arrangements relating to the subject matter of these Terms & Conditions. Neither party shall be entitled to rely on any agreement, understanding or arrangement that is not expressly set forth in these Terms & Conditions.

Governing Law and Dispute Resolution

These Terms & Conditions, including but not limited to the arbitration provisions contained in this section, are governed by and construed in accordance with the laws of Hong Kong.
You agree that any claim or dispute at law or equity that has arisen or may arise between us relating in any way to these Terms & Conditions, any prior version of these Terms & Conditions, or your use of or access to our e-Store, the Website and/or the Mobile App, will be resolved in accordance with the provisions of this section.
You agree to first contact each other with regard to any claim or dispute, and to provide a written description of the problem together with all relevant documents/information and the proposed resolution. We will contact you based on the contact information stored in our user database and/or provided to us. Notice to us must be sent to: Room 707, 7/F, 200 Hennessy Road, Wan Chai, Hong Kong or cs@vino-intel.com.
If after 60 days the parties are unable to resolve any dispute raised, the parties agree that the dispute must be submitted to arbitration consistent with this section, except that you may assert eligible claims in the small claims tribunal in Hong Kong.
You agree that any claim, dispute, controversy or difference between the parties to these Terms & Conditions, and any claim by you against us (or any of our associated parties) or a Seller or, to the full extent permitted by applicable law, third parties who are not parties to these Terms & Conditions, including the existence, validity, interpretation, performance, breach or termination thereof or any dispute regarding non-contractual obligations arising out of or relating to these Terms & Conditions shall be referred to and finally resolved by arbitration in the presence of three arbitrators of whom one shall be appointed by you, one shall be appointed by us and one shall be appointed by agreement between you and us, failing which he/she will be appointed by the Hong Kong International Arbitration Centre (“HKIAC”), and shall be administered by the HKIAC under the HKIAC Administered Arbitration Rules in force when the Notice of Arbitration is submitted. The seat of arbitration shall be Hong Kong, and the arbitration proceedings shall be conducted in English.
Further, you agree that any arbitration will be solely between you and us, not as part of a class action claim (i.e., not brought on behalf of or together with another individual's claim). If for any reason any court or arbitrator holds that this restriction is unconscionable or unenforceable, then our agreement to arbitrate doesn't apply and the class action dispute must be brought in court of Hong Kong.

We reserve the right to add, alter or amend these Terms & Conditions without prior notice. Thank you for your kind understanding.

Exhibit A

Order and Delivery Terms

1. Payment Methods

We accept the following payment methods: Visa, Mastercard, American Express (Amex), UnionPay, Alipay, WeChat Pay, Apple Pay, Google Pay and FPS.

All transactions are securely processed using encryption technology to protect your personal and payment information.

2. Shipping Fees

For each individual supplier, orders over HKD $800 qualify for free delivery.
Orders below this threshold will incur a delivery fee of HKD $100 (charged per 6 bottles).
If delivery fails due to an incorrect address or unsuccessful recipient contact, additional charges may apply.

An additional HKD $30 surcharge will apply to deliveries to the following areas if the order does not meet the free shipping threshold: Sai Kung, Clear Water Bay, Shek O, Stanley, Discovery Bay, Ma Wan, and South Lantau Island.

For deliveries to special locations such as piers, airports, logistics companies/centers/warehouses, Hong Kong Convention and Exhibition Centre (HKCEC), Asia World-Expo, and similar venues, a HKD $300 surcharge will be applied.

We currently only deliver within Hong Kong. Cross-border shipping is not available at this time.

3. Order Cut-off Time

Our daily order cut-off time is 11:00 AM.

Orders placed before 11:00 AM will be processed on the same business day.
Orders placed after 11:00 AM will be processed on the next business day.

4. Delivery Arrangement

We use SF Cold Chain for all deliveries to ensure your wines are transported under optimal temperature conditions.

Delivery typically takes 2 to 7 business days after dispatch.
You will receive notifications from the driver before and after delivery.
Specific delivery times cannot be scheduled.
No delivery service is available on Sundays or public holidays.
In the event of Typhoon Signal No. 8 or above, or Black Rainstorm Warning, delivery will be postponed to the next working day.

Upon receipt, customers are advised to inspect the delivery immediately and store wines in a wine fridge or other cool environment to preserve quality.

5. Fast Delivery Service

For specific products marked with the "Fast Delivery" label, customers may select this service at checkout. The specific terms are as follows:

Service Coverage and Limitations:
- This service covers major commercial and residential areas in Hong Kong Island, Kowloon, and the New Territories only.
- Excluded Areas: This service is NOT available for remote areas (including Sai Kung, Clear Water Bay, Shek O, Stanley, Discovery Bay, Ma Wan, South Lantau) and special locations (such as piers, the airport, logistics centers, exhibition centers, etc.).
- Service Hours: Available Monday to Friday only (excluding Public Holidays). Daily delivery operations commence at 12:00 PM.
Cut-off Time and Delivery Standard:
- The daily cut-off service time is 18:00 PM.
- Normal Service Hours: Orders placed between 12:00 PM and 18:00 PM: Delivery will likely be completed within 4 hours of order confirmation on the same day.
- Outside Service Hours: Orders placed between 18:01 PM (Day T) and 11:59 AM (Day T+1):
  - Next day delivery: For order received between 18:01 PM -11:59 PM (Day T). Dispatch will commence on the next business day, and delivery will likely be completed before 16:00 PM on Day T+1.
  - Same day delivery: For order received between 00:00 AM till 11:59 AM, Dispatch will commence on the the same business day, and delivery will likely be completed before 16:00 PM.

Fast Delivery fees are calculated progressively based on "Units" and "Region":
Unit Conversion: Standard Bottle (750ml) = 1 Unit; Magnum Bottle (1.5L) = 2 Units.
Fee Tiers: Fees are charged per tier of 3 Units (e.g., 1-3 Units = 1x fee; 4-6 Units = 2x fee, and so on).
Regional Rates (Per Tier):
- Hong Kong Island: HK$100
- Kowloon: HK$150
- New Territories: HK$200
Surcharge: If the total order amount is below the HK$800 free shipping threshold, an additional HK$100 Basic Shipping Fee will be charged on top of the Fast Delivery fee.
Delivery Method and Important Notes:
- This service is fulfilled by dedicated courier partners (e.g., Lalamove, GOGOX) to ensure speed; the use of temperature-controlled trucks is not guaranteed.
- Service will be suspended and rescheduled in the event of severe weather conditions (Typhoon Signal No. 8 or Black Rainstorm Warning).
- Please ensure someone is available to receive the shipment during the delivery window. If delivery fails due to the recipient's unavailability, a re-delivery fee will be charged.

6. Returns & Damages

We strive to deliver wines in excellent condition. However, please understand that natural variations in packaging—such as cases, labels, and corks—may occur due to vintage, storage, or transit. These are considered normal and acceptable.

Therefore, we do not accept any returns, exchanges, or cancellations. Once an order is placed, it is considered final and cannot be amended or withdrawn.

If you discover any damage or discrepancy upon delivery, please contact us within 24 hours and provide photographic evidence. Requests submitted after this period will not be accepted.

All wines are shipped under refrigerated conditions to safeguard quality.
Customers are responsible for proper storage after delivery.

VinoBuzz Loyalty Program – Points Rules (V4.2)

Top Up & Earn, Spend with Ease

1. Definitions

1.1 Cash Points

A member may earn one point for each HK$1 topped up (each a “Cash Point”).

1.2 Bonus Points

Additional points may be granted by VinoBuzz as bonus to certain members (the “Bonus Points”). These include:

1.2.1 Welcome Bonus Points: welcome bonus points are available for new members who register with an invitation code. Welcome Bonus Points are activated only after the first cash top up is completed.

1.2.2 Promotional Bonus Points: VinoBuzz may grant promotional bonus points during top up promotions or other campaigns at its sole discretion.

1.3 Expiry Date

1.3.1 Cash Points: valid for 365 days from the date of issuance. Each new top up extends the validity of the entire unexpired Cash Point balance by 365 days.

1.3.2 Bonus Points (including Welcome Bonus Points): valid for 180 days from issuance and the validity cannot be extended.

1.3.3 Expired Cash Points and Bonus Points will be forfeited automatically.

2. Earning Points

2.1 Members earn 1 Cash Point for every HK$1 topped up.

2.2 VinoBuzz may grant Bonus Points for qualifying top ups or promotions at its sole discretion.

2.4 The maximum amount of Bonus Points that can be earned may be capped by month or campaign. Limits will be displayed in the Top Up checkout section.

3. Use of Points

3.1 Points are available for redemption immediately upon issuance., provided that welcome Bonus Points must first be activated by completing a cash top up.

3.2 Points may be applied to wine product value, subject to:

3.2.1 Minimum Cash Spend: Each transaction must include at least HK$200 in cash.

3.2.2 Bonus Point Limit: A maximum amount of Bonus Points that can be applied per order is 100 Bonus Points, subject to adjustment from time to time.

3.2.3 Bonus Points will always be deducted before Cash Points when available.

3.4 Restrictions:

3.4.1 Shipping, delivery, service charges, and taxes must be paid in cash unless explicitly stated otherwise.

3.4.2 Points are nontransferable, non-withdrawable, and cannot be exchanged for cash.

3.4.3 Members can check point balances and transaction history at My Account.

4. Refunds, Cancellations, and Fraud

4.1 If a payment fails or an order is cancelled, all points used will be automatically returned once the cancellation or refund is processed.

4.2 For partial refunds, points will be restored proportionally according to the refunded value.

4.3 VinoBuzz reserves the right to reverse, withhold, or cancel points where transactions are fraudulent, misused, or subject to chargeback.

5. Disputes and Errors

5.1 In the event of discrepancies, VinoBuzz’s platform backend records shall prevail.

5.2 Errors will be corrected within a reasonable period.

6. Amendments and General Terms

6.1 VinoBuzz may update these Points Rules at any time.

6.1.1 Material changes will be shown on website notice.

6.1.2 Minor changes take immediate effect once published on the platform.

6.2 The most updated version available on the VinoBuzz website shall apply.
